GENERAL TERMS AND CONDITIONS OF SALE OF LOUISA BRACQ

ARTICLE 1 – SCOPE OF THE GENERAL TERMS AND CONDITIONS OF SALE

These general terms and conditions of sale (hereinafter the "GTC") apply to any creation of a customer account and any order placed on the website at www.louisabracq.com/en (hereinafter the "Site"), which is operated by PBSE, hereinafter "LOUISA BRACQ".

The offers proposed by LOUISA BRACQ are intended exclusively for adult natural persons acting for non-professional purposes and having the legal capacity to contract (hereinafter the "Customer").

The GTC are made available to the Customer on the Site and at the time of placing the order and must be accepted by the Customer. Accordingly, the Customer's order constitutes full acceptance, without restriction or reservation, of the GTC. LOUISA BRACQ reserves the right to adapt or modify the GTC at any time. The applicable GTC are those in force on the day the order is placed.

ARTICLE 2 – PRODUCTS

The products offered for sale by LOUISA BRACQ are those presented and available on the Site, subject to stock availability. Product pages specify their essential characteristics, including color, composition, size, and price. For any questions, the Customer is invited to contact Customer Service.

LOUISA BRACQ makes every effort to present its products as accurately as possible. However, photographs on the Site may not perfectly match the actual product, and visual differences, particularly in color, may occur due to technical constraints.

ARTICLE 3 – PRICES

Product prices are indicated on the Site in Euros, all taxes included, in effect on the day of the order. They include VAT and any applicable discounts on the day of the order.

Product prices do not include delivery fees (shipping, packaging, and handling according to the current rates). The delivery charges will be specified to the Customer before the order is confirmed.

ARTICLE 4 – ORDER

To place an order, the Customer is invited to identify themselves and create a customer account. They must select the products of their choice, available on the Site, using the available filters if applicable, choose their size and desired quantities, and add their selection to the "cart". The Customer may review and modify the contents of their cart before confirming the order. The GTC will be presented for acceptance at the time of the order. The order implies the Customer’s acceptance to pay the price. The Customer must provide accurate and up-to-date personal information and specify the delivery address.

The order is validated after payment following confirmation from the bank of the successful payment. Once the order is validated, the Customer receives an order confirmation email. Any order placed and validated on the Site constitutes a firm order and cannot be modified or canceled, but may be subject to withdrawal by the Customer.

ARTICLE 5 – PAYMENT METHODS

Payment is made by credit card or PayPal at the time of the order. The Customer guarantees that they are the legitimate holder or user of the payment method used. Any incorrect information provided by the Customer may block the order. LOUISA BRACQ informs the Customer that credit card payment information is collected solely for the proper execution of the payment. For any other form of payment, the Customer is invited to contact Customer Service.

ARTICLE 6 – DELIVERY

LOUISA BRACQ ships products within an average of 3–5 business days from order validation for products in stock and shipped within metropolitan France. This delay may be extended up to 10 days for restocking or during sales periods. In the event of a delayed shipment, LOUISA BRACQ will inform the Customer as soon as possible and allow them to cancel the order if the proposed delay is unsuitable. Free delivery applies for orders over €70 in France and Belgium, and over €149 for other EU countries.

Orders are shipped to the delivery address provided by the Customer at the time of the order, according to the delivery method selected. Upon delivery, it is the responsibility of the Customer or the person receiving the package on their behalf to check the package’s condition, contents, and compliance in order to report any defects observed at the time of delivery, such as a damaged package, incorrect product, defective, damaged, or incomplete items. A package that cannot be delivered due to the Customer’s absence is not considered a delivery defect.

ARTICLE 7 – RIGHT OF WITHDRAWAL

In accordance with Articles L. 221-18 and following of the French Consumer Code, the Customer has a right of withdrawal within fourteen (14) days from receipt of the entire order, without having to provide any reason. To exercise this right, the Customer must inform LOUISA BRACQ of their decision before the deadline, using the withdrawal form provided in the annex or by email/postal notification to Customer Service.

Products subject to withdrawal must be returned in their original and perfect condition, complete, fully tagged, new, unworn, unwashed, unstained, and undamaged within 14 days of exercising this right. Return costs are borne by the Customer.

LOUISA BRACQ will refund all amounts paid, including delivery charges, within 14 days of receiving the products or proof of their shipment. If only part of the order is returned, delivery fees will not be refunded.

ARTICLE 8 – LIABILITY

LOUISA BRACQ’s liability is governed by applicable laws and cannot be held responsible for errors in the order or delivery address or in cases of force majeure.

Without prejudice to the legal guarantees mentioned below, LOUISA BRACQ shall not be liable for damages resulting from:

• Non-compliance by the Customer or recipient with care instructions provided on the product label;

• Misuse or inappropriate use of products not corresponding to their normal and foreseeable purpose.

ARTICLE 9 – GUARANTEES

9.1 Legal Guarantee of Conformity

LOUISA BRACQ guarantees that products comply with applicable French law regarding legal conformity, including the right to return non-compliant or defective products.

The consumer has two years from delivery to invoke the legal guarantee of conformity. For products containing digital elements supplied continuously over more than two years, the legal guarantee applies throughout the provision period.

The guarantee entitles the consumer to repair or replacement within thirty days of request, free of charge and without major inconvenience. Repair extends the original guarantee by six months.

The consumer may request a price reduction or contract termination if:

1. The seller refuses repair or replacement;

2. Repair/replacement occurs after thirty days;

3. Major inconvenience arises for the consumer;

4. Non-conformity persists despite the seller’s attempts.

The consumer is not entitled to terminate the sale for minor defects.

9.2 Legal Guarantee Against Hidden Defects

LOUISA BRACQ guarantees products against hidden defects according to Articles 1641–1649 of the French Civil Code.

ARTICLE 10 – PERSONAL DATA

LOUISA BRACQ acts as data controller for personal data collected on the Site for account creation, order processing, and newsletter registration. Mandatory data must be provided to process requests.

Legal basis varies: consent for newsletter, contractual obligations for account/orders, and legal obligations for accounting purposes. Data are retained for the duration of the purpose plus any legal prescription and are used exclusively by LOUISA BRACQ and its service providers.

The Customer has rights to access, correct, erase, restrict, object, and port data, and to file a complaint with CNIL. The Customer may also register on Bloctel to oppose telemarketing: https://www.bloctel.gouv.fr.

ARTICLE 11 – INTELLECTUAL PROPERTY

The Site is published by PBSE, SAS, 102 rue Roger Salengro, 59157 Fontaine-au-Pire, France. The Site content, including graphics, photos, descriptions, drawings, models, and logos, is the exclusive property of LOUISA BRACQ and cannot be used without prior express authorization.

ARTICLE 13 – APPLICABLE LAW AND JURISDICTION

These GTC and resulting operations are governed exclusively by French law. Any dispute relating to the interpretation or execution of a sale is subject to the competent courts under ordinary law.
